J.D. 1985, Columbia University, School of Law Practice information John has devoted his entire legal career to representing labor unions and their members in arbitration, administrative and judicial proceedings. He has proudly advocated for a wide variety of employees, including electrical workers, school and postal employees, bus and truck drivers, food processing workers, police officers, firefighters and steelworkers. He has handled cases arising under state laws such as Oregon’s Public Employee Collective Bargaining Act and its Fair Dismissal Law for teachers, and cases arising under federal laws such as the National Labor Relations and Railway Labor Acts. John regularly appears before arbitrators and administrative law judges. He also handles cases in the federal and state courts, including at the appellate levels. A few of the significant labor law cases John has handled are listed below: Blue Mountain Faculty Ass'n, et al. v. Blue Mountain Community College (Oregon Employment Relations Board); Won unfair labor practice case for faculty employees resulting in restoration of status quo in bargaining, "make whole relief," civil penalty and extraordinary attorney fee award; convinced Employment Relations Board that college had committed "at least six separate violations of its duty to bargain in good faith" and that the violations were "flagrant" and "egregious." Oregon Trail School District No. 46 v. East County Bargaining Council/OEA/NEA (Oregon Employment Relations Board); Successfully defended teachers’ right to strike in response to school district petition to have strike declared unlawful. Clark County Public Utility District No. 1 v. IBEW, Local 125 (Washington Supreme Court); Won reversal of trial court’s invalidation of labor arbitration award which had reinstated laid off employees; supreme court clarified the narrow standard of judicial review for such awards. Teamsters Local 670 v. City of Vale (Oregon Employment Relations Board); Won “make whole relief” for police officers wrongfully laid off before employer completed its obligations to bargain with union. Lane Unified Bargaining Council v South Lane School District 45J3 (Oregon Supreme Court); Won reversal of Employment Relations Board decision dismissing complaint against employer that had refused to arbitrate association’s grievance.
